If you were injured at a construction site in New York State, you cannot sue your employer. You can however go after the general contractor if there was one. If there was not a general contractor, the law imposes the burden of maintaining a safe property or safe workplace upon the owner of the property, even if the contractor doesn’t work for the owner of the property or maybe they don’t even know who the owner of the property is. The law imposes a strict burden on the property owner to keep construction workers safe.
