In New York, pure comparative negligence rules are used for accident claims. Under this legal rule, you can file a claim against another party as long as that party is at least 1% liable for your injuries. It can be expected that multiple claims and lawsuits will start after a rideshare accident in New York for this reason, so you should know who to handle everything ahead of time.
Uber & Lyft Insurance Policies
The only “benefit” of a rideshare accident with an Uber or Lyft driver is that the rideshare companies can offer significant insurance policies following a crash. If your case qualifies to use this insurance, then you could stand to have all or most of your damages covered. However, the rideshare companies will probably make it difficult to get the benefits you need, so you should not assume that you will automatically get insurance coverage just because it says on paper that you should.
Uber’s insurance – and Lyft’s with some minor changes – can be described in three phases:
- Offline: When the rideshare driver is offline or not using the Uber app, Uber provides no coverage and accepts no responsibility for any accidents caused by the driver. Accident claims will need to be filed against the driver’s auto insurance policy that they bought themselves.
- Online: When the rideshare driver is online and waiting for a fare, Uber can provide third-party liability insurance in the amounts of $50,000 in bodily injury per person, $100,000 in bodily injury per accident, and $25,000 in property damage per accident. This policy only applies if the driver’s personally purchased policy does not.
- En route: When the rideshare driver has accepted a fare and is going to pick up the passenger, or already has picked up the passenger, Uber can provide the largest insurance coverage. Up to $1,000,000 in third-party liability damage coverage is possible, as well as policy clauses for uninsured/underinsured motorist bodily injury coverage and contingency comprehensive and collision coverage with a deductible.
Evidence for a Rideshare Accident Case

For example, identifying information from the rideshare driver will be more than just their driver’s license and insurance details. You should also get any details about how they are identified on the app, such as a driver serial number. There might also be a specific number assigned to your ride.
